These Terms of Service (the "Terms") are an agreement between you and AutoBidPilot (the "Operator", "we", "us") about your use of AutoBidPilot at https://autobidpilot.com (the "Service"). By creating an account, ticking the agreement box or otherwise using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Important: using auto-bidding is at your own risk.
AutoBidPilot is not affiliated with, sponsored by or endorsed by Freelancer.com. Freelancer.com's User Agreement restricts automated access to its platform, including through its API, without Freelancer.com's written permission. Using auto-bidding may therefore lead Freelancer.com to limit, restrict or suspend your Freelancer.com account. You choose whether to enable auto-bidding, you do so entirely at your own risk, and you are solely responsible for complying with Freelancer.com's terms and policies. The Service
AutoBidPilot is a web tool for freelancers. After you connect your own Freelancer.com account, it can search Freelancer.com projects that match your skills and filters, help write a proposal for each, and place bids on your behalf, either one at a time when you ask (manual bids) or automatically in runs that you start and can stop (auto-bidding). It follows the instructions, limits and pricing you configure. It also provides profile management, statistics, templates, a credits balance, referral rewards and support tools. The Service is provided as it exists today and may change.
Freelancer.com rules and your risk
- Your responsibility. Your Freelancer.com account is governed by Freelancer.com's own terms, User Agreement, API terms, fair-use and bidding policies. You are solely responsible for complying with them, and for deciding whether using AutoBidPilot is permitted for you.
- Automated access is restricted. Freelancer.com's User Agreement restricts automated access to its platform, including through its API, without Freelancer.com's written permission. We do not hold any such permission on your behalf and we cannot grant it.
- Account action. Using auto-bidding may lead Freelancer.com to limit your bidding, restrict, suspend or close your Freelancer.com account, remove bids or withhold funds or reputation. We have no control over those decisions and are not responsible for them or for any resulting loss of income, projects, reputation or account access.
- Not affiliated. AutoBidPilot is independent. It is not affiliated with or endorsed by Freelancer.com. "Freelancer" and "Freelancer.com" are trademarks of their owner and are used only to describe compatibility.
- Your choice. Connecting Freelancer.com and enabling auto-bidding are your decisions. You can stop a run, disconnect Freelancer.com and revoke our access at any time. If Freelancer.com tells you to stop, or restricts your account, stop using auto-bidding straight away.
- Platform limits. Freelancer.com decides its own bid allowances, rate limits, verification requirements and minimum balances. The Service reacts to those limits (for example by slowing down or stopping a run) but cannot override them.
Eligibility
You must be at least 18 years old and able to enter a binding contract. You must be allowed to use Freelancer.com and to bid for work. If you use the Service for a business, you confirm you have authority to bind it. You may not use the Service where it is prohibited by law.
Your account
- Give accurate information and keep it up to date. Verify your email address when asked.
- You are responsible for everything done through your account, including bids placed by your auto-bidding runs and by anyone you let use your account. Keep your password and sign-in methods (Google, GitHub) secure and tell us at once if you suspect misuse.
- One Freelancer.com account can be linked to only one AutoBidPilot account. Do not create several AutoBidPilot accounts to obtain extra credits, referral rewards or to avoid limits.
- You are responsible for the content you store (your profile text, templates, preferences) and confirm you have the right to use it.
Credits and payments
- Pay per bid. Each bid actually placed on Freelancer.com costs 1 credit (the amount shown in the app). Searching for projects and writing proposals do not cost credits. A credit is reserved before a bid is sent.
- Free and reward credits. We may grant free credits, for example when you first connect a Freelancer.com account, and referral rewards under the referral program. We may change, limit or stop these offers, and may withhold or reverse them if we believe they were obtained by abuse or fraud.
- Refunds of failed bids. If Freelancer.com refuses a bid or placement fails, the credit for that bid is returned automatically. If a placement times out and we cannot tell whether it went through, the credit may be kept; contact support and an administrator can review and refund it. A bid that Freelancer.com accepted is not refunded, even if you later withdraw it or it wins nothing.
- Adjustments. Administrators can add credits to or remove credits from your account (for example to correct an error or reverse an abuse). Every change is recorded in your credits history.
- No cash value. Credits are a limited, non-transferable licence to use the Service. They have no cash value, cannot be exchanged for money, sold, gifted or transferred between accounts, and are forfeited if your account is closed.
- No online payments yet. At the moment we do not take card or online payments. Credits are granted or added to your account by our administrators.
AI-generated proposals
Proposals are written by a third-party AI proposal-writing service from the project text and your profile facts, then checked by us. AI text can be wrong, generic or inappropriate. You are responsible for every proposal sent from your Freelancer.com account, whether you reviewed it first or it was sent automatically in a run you started. Review your style settings, templates, portfolio links and profile facts, and review sent proposals regularly. Do not rely on a proposal to be accurate, original or suitable. You must make sure that anything sent in your name is true and that you can deliver what is claimed.
Acceptable use
You agree not to:
- break any law, or Freelancer.com's terms and policies, or the rights of others;
- send spam, misleading, deceptive or abusive bids, or bids for work you cannot or do not intend to perform;
- use the Service to bypass limits, verification or restrictions set by Freelancer.com or by us, or to evade a suspension or ban;
- attempt to access other users' data, probe or attack the Service, overload it, or interfere with its security;
- reverse engineer, scrape, resell or provide the Service to third parties, or use it to build a competing service;
- use bots, multiple accounts or other means to claim credits or referral rewards you are not entitled to;
- upload unlawful or harmful content (including malware) in support tickets or elsewhere;
- put other people's confidential or personal data into the Service without the right to do so.
We can set and change limits (such as bids per hour, run length or poll speed) to protect the Service and Freelancer.com's platform.
No guarantee of results
We do not promise that you will win any project, receive replies, earn any income, keep your Freelancer.com standing or that any bid will be accepted. Outcomes depend on clients, competition, your profile and Freelancer.com. Statistics and match scores are estimates.
Availability and changes
We aim to keep the Service running but do not promise it will be uninterrupted or error-free. It depends on Freelancer.com's API and on third-party services that can be slow, change or fail. Auto-bidding runs may pause, stop or fail to start, and we may suspend or limit the Service for maintenance, security or to protect Freelancer.com's platform. We may change, add or remove features, and may amend these Terms as described below.
Termination
You can stop using the Service at any time and ask us to delete your account. We may suspend or end your access, stop your runs and remove credits if you breach these Terms, if we suspect fraud or abuse, if Freelancer.com asks us to or restricts the connected account, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including disclaimers, liability, indemnity and governing law) continue after termination.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation. Some jurisdictions do not allow certain exclusions, so some of these may not apply to you.
Limitation of liability
To the fullest extent permitted by law, the Operator and its owners, staff and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, income, projects, goodwill, reputation, data or account access, including loss arising from action taken by Freelancer.com against your account. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim (which may be zero while credits are free) and USD 100. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud or for death or personal injury caused by negligence.
Indemnity
You will defend and indemnify the Operator and its owners, staff and suppliers against claims, losses, damages and expenses (including reasonable legal fees) arising from your use of the Service, the bids and proposals sent from your account, your content, your breach of these Terms or of Freelancer.com's terms, or your violation of any law or third-party right.
Governing law
These Terms and any dispute arising out of them or the Service are governed by the laws of the jurisdiction in which the Operator is established, without regard to conflict-of-law rules. Mandatory consumer-protection rights that apply to you where you live are not affected.
General
- Changes. We may update these Terms. We will change the "Last updated" date, and for material changes we will tell you in the app or by email. If you keep using the Service after the change takes effect, you accept the new Terms. If you do not agree, stop using the Service and ask us to close your account.
- Entire agreement. These Terms and the Privacy Policy and Cookie Policy are the whole agreement between you and us about the Service.
- Severability and waiver. If a part of these Terms is unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example in a sale of the business.
- Notices. We may notify you in the app or at your account email address.
